Short answer

Regulation 23(1) says a learner enrolled in an open and distance learning and/or online programme at an institution recognised under these regulations shall be eligible for mobility from one mode to another within that institution, as its Act provides and with the approval of its statutory authorities. Where a regulatory authority or statutory council governs the programme, the institution shall take that council's permission. Eligibility under those conditions is the rule. The regulation does not say that every request is granted, that the move can be to a different university, or that the destination mode is approved because the current mode is.

What the FAQ quotes

On 28 October 2026 the FAQ quoted regulation 23(1):

A learner enrolled for a programme under Open and Distance Learning mode and/or Online mode in a Higher Educational Institution recognised by the Commission under these regulations shall be eligible for mobility from one mode of learning to another mode of learning within the Higher Educational Institution as per the provisions stipulated under its Act and with the approval of statutory authorities of the Higher Educational Institution; Provided that in case a programme is under the domain of regulatory authority/statutory council, Higher Educational Institution shall take permission from the concerned regulatory authority/statutory council for mobility of learners under such programmes.

The English text of the 4 September 2020 gazette matches that quotation. The mobility is inside the higher educational institution. The Act and the statutory authorities are both conditions. A programme under a regulatory authority or statutory council adds that authority's permission.

What remains the institution's own rule

The regulation does not publish a national list of programmes that allow a change, a fee, or a deadline. Where the institution has such a rule, it is the institution's rule. If the institution cannot point to the Act or the statutory approval, regulation 23(1) has not by itself established the change.

The destination mode still needs its own recognition

Moving into online or open and distance learning mode still requires that the destination mode is one the institution is recognised to offer for that programme and session. Moving into conventional mode is a change of mode. It is not evidence that the earlier mode was recognised. Equivalence under regulation 22 is a different rule from permission to change mode during the programme.

What you should check yourself

  • The institution's published rule for changing mode, and the statutory approval it relies on.
  • Permission from the regulatory authority or statutory council, where the programme is under one.
  • That the mode being entered is recognised for that programme and session.
  • That the change is inside the same institution. The quoted sentence describes mobility within the higher educational institution.

A common misconception

Equivalence of the final degree means a learner can move between regular, online, and distance at will, including to another university. Regulation 23(1) makes the learner eligible for mobility inside one recognised institution, under its Act and with statutory approval, and with council permission where the programme requires it. Equivalence of an award is article 3.
